1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, products, and services provided by Element Longevity Inc. (“Element Longevity,” “we,” “us,” or “our”), including but not limited to www.ElementLongevity.com and any related subdomains, mobile apps, or services (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent and warrant that you meet these requirements.

3. Services and Health Disclaimer

Element Longevity provides health and wellness products, microbiome testing services, and related educational resources. Our products and Services are not intended to diagnose, treat, cure, or prevent any disease and should not be considered a substitute for professional medical advice. Always consult with a qualified healthcare provider before making changes to your diet, exercise, or supplement regimen.

4. Account Registration and Security

You may be required to create an account to access certain Services. You agree to:

  • Maintain the security of your account credentials

  • Notify us promptly of any unauthorized use of your account

You are responsible for all activity under your account.

5. Orders, Payments, and Subscriptions

When you purchase products or Services, you agree to provide accurate billing and payment information. All fees are due at the time of purchase unless otherwise specified.

If your purchase includes a subscription:

  • Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal

  • You may cancel by logging into your account or contacting support@ElementLongevity.com

We reserve the right to refuse or cancel any order for any reason, including suspected fraud or violation of these Terms.

6. Shipping and Returns

Shipping times are estimates and not guaranteed. Title and risk of loss pass to you upon our delivery to the carrier.
Return eligibility, timelines, and refund policies are detailed in our Return Policy, which is incorporated into these Terms.

7. Intellectual Property

All content, trademarks, service marks, logos, and other intellectual property appearing on the Services are owned by or licensed to Element Longevity. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

8. Prohibited Uses

You agree not to use the Services to:

  • Engage in fraudulent or deceptive activity

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELEMENT LONGEVITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Element Longevity and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles.

15. Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You agree that any dispute, claim, or controversy between you and Element Longevity arising out of or relating to these Terms or the Services will be resolved exclusively through binding arbitration, except that either party may seek injunctive relief in court for alleged intellectual property infringement.

Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) before a single arbitrator. The place of arbitration will be Hennepin County, Minnesota unless otherwise agreed. You and Element Longevity waive the right to a jury trial and to participate in any class action or representative proceeding.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date. Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
